Congratulations to all the members. SNATTA CHQ is very glad to inform that we have won against the injustice done to DRTTAS in the case of JTO (Telecom) departmental Examination notified on 21.12.2009. In this notification cut off date for counting qualifying service is retrospectively fixed as 01.7.2009 & due to this great injustice was done with the DRTTAs and only around 700 DR TTA’s were eligible to appear in this examination, while almost all the TTA’s have completed 7 year service in the department but were unable to appear in the examination. In order to fight against this injustice SNATTA CHQ in Delhi CEC had decided to file a court case in Hon’ble Principal CAT New Delhi & our President Manish Samadhiya was named as the main petitioner in this case.
After several hearings & relevant document submissions by SNATTA CHQ & SNATTA members. The matter has been heard on merits by the Principal Bench of the Central Administrative Tribunal and the judgment has been reserved. During the hearings of the case, it appeared that the Bench is agreeable with our submissions. The Bench enquired on several aspects of the matter and the counsel for the BSNL found it difficult to respond to the queries. The Tribunal did note the fact that since 2001 no examination has been held and the counsel for the BSNL was relying on erstwhile rules to justify the cut off date as 1st July 2009.
The corrigendum issued for JTO (Electrical) LICE by the BSNL management Dated 14.01.2011, may be a result of the feedback given by the BSNL's counsel on the hearing of our case and the management may have realised that it would be difficult to justify the cut off date as 1st July for JTO (Electrical) cadre also. Also 3 cases were filed in 3 circles & in one circle we have already won the court case & order is available with us & remaining 2 cases are also in the final stage.
